Terms of Service

These Terms of Service ("Terms") govern your access to and use of GourmetVision AI, including gourmetvision.app and related features. By creating an account, purchasing a plan, or using the service, you agree to these Terms.

1. Eligibility and accounts

You must be legally able to enter into a binding agreement and provide accurate account information. You are responsible for activity under your account and for protecting your sign-in credentials. Notify us promptly if you believe your account has been compromised.

2. The service

GourmetVision provides AI-assisted food photography, image editing, content organization, social content, scheduling, nutrition estimation, and related restaurant marketing tools. Features may change as we improve the product, respond to provider changes, or protect service reliability and security.

3. Your content

You retain ownership of content you upload and of any rights you have in generated results. You grant GourmetVision a limited, non-exclusive license to host, process, reproduce, and transmit your content only as reasonably necessary to operate, secure, and provide the service and the features you request.

You represent that you have the rights and permissions necessary to upload, edit, generate from, publish, and share your content, including logos, photos, trademarks, and other materials belonging to third parties.

4. AI-generated content

AI systems can produce inaccurate, incomplete, unexpected, or similar results for different users. You are responsible for reviewing outputs before publishing or relying on them. We do not guarantee that an output will be unique, error-free, suitable for a particular purpose, or free of third-party rights issues.

Nutrition and calorie features provide estimates based on available information and are not medical, dietary, or professional health advice. Do not use them as a substitute for qualified professional guidance or required food-labeling analysis.

5. Acceptable use

You may not use GourmetVision to violate law or third-party rights; access accounts or systems without authorization; distribute malware; evade usage controls; abuse APIs; interfere with service operation; submit content you are not permitted to process; or use the service to facilitate fraud, deception, harassment, or other harmful conduct. We may limit or suspend abusive activity to protect the platform and other users.

6. Plans, Lens usage, and add-ons

Some features require a paid subscription or Lens balance. Current plan allowances, feature access, prices, billing periods, and add-on limits are shown in the service before purchase. Lens costs may differ by operation because AI and image-processing workloads have different provider costs.

Promotional or trial Lens may be limited, non-transferable, and may expire or be subject to fair-use controls. Paid subscription allowances and add-ons are applied according to the plan and purchase terms displayed at checkout.

7. Billing and cancellation

Payments are processed by Stripe. Recurring subscriptions continue until canceled. You can manage an eligible paid subscription through the billing portal made available in the service. Cancellation stops future renewal but generally does not retroactively reverse service already provided, except where required by law or expressly stated at purchase.

Taxes, exchange-rate effects, payment-provider fees, and bank charges may apply where relevant. We may correct obvious pricing or billing errors.

8. Third-party integrations

GourmetVision may connect with Google, Facebook, Instagram, Stripe, Firebase, Google AI, and other third-party services. Your use of those services remains subject to their terms and policies. We are not responsible for changes, outages, suspensions, API restrictions, or decisions made by third-party platforms.

9. Social publishing and shared galleries

When you authorize a social or business-profile integration, you instruct GourmetVision to perform the selected publishing actions on your behalf. Review content, target accounts, dates, and permissions before scheduling or posting.

Client gallery links are designed to be unguessable and time-limited, but anyone who obtains a valid link may view the shared items until the link expires. You are responsible for choosing what to share and with whom.

10. Intellectual property

GourmetVision software, branding, interfaces, documentation, and other service materials are protected by intellectual-property laws. Except for rights expressly granted in these Terms, we and our licensors retain our respective rights in those materials. These Terms do not grant you ownership of the GourmetVision service or trademarks.

11. Availability and changes

We work to provide a reliable service, but availability is not guaranteed. Maintenance, provider outages, safety measures, usage limits, or technical failures may temporarily affect features. We may modify or discontinue features, and we will use reasonable efforts to avoid unnecessary disruption to paid users.

12. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access for material violations of these Terms, unlawful use, fraud, security threats, nonpayment, or conduct that creates significant risk to the service or others. Where practical, we may provide notice and an opportunity to address the issue.

13. Disclaimers

To the maximum extent permitted by applicable law, GourmetVision is provided on an "as is" and "as available" basis. We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement where such disclaimers are legally permitted.

14. Limitation of liability

To the maximum extent permitted by applicable law, GourmetVision will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from use of the service. Nothing in these Terms excludes liability that cannot legally be excluded or limited.

15. Changes to these Terms

We may update these Terms to reflect product, legal, security, or operational changes. The current version will be posted here with a revised effective date. If a change materially affects existing paid use, we may provide additional notice where appropriate.
